Terms of use

Applies to: stockarena.eu and the StockArena app for web, Android and iOS, including the beta programme

1. StockArena and provider

StockArena is a non-commercial leisure and hobby project for stocksport that I develop and operate as a private individual.

StockArena is currently offered free of charge and without profit motive. There is no entitlement that it remains free, available or unchanged. If paid functions are offered later, separate terms may apply. Paid use does not arise automatically.

2. Scope

These terms cover the website, web app, Android and iOS apps, accounts, beta, training, encounters and scoresheets, pairing, groups, events and polls, feedback, and views shared publicly or by link.

Personal data are governed by the separate privacy notice at https://stockarena.eu/datenschutz. Accepting these terms is not a blanket consent to processing.

3. Use agreement

Registering an account and confirming these terms creates a free-of-charge use agreement. Where areas can be used without an account, the terms apply analogously. Applying for closed beta alone gives no right to approval or participation.

4. Purpose

StockArena is a technical aid for organising and documenting stocksport (training, encounters, scoresheets, pairing, groups, events, images, signatures and shared views).

No official sporting decision

Results, tables, points, pairings, statistics or other sporting information calculated or shown by StockArena do not replace a binding decision of a referee, organiser, federation or other competent sporting body. Official rules prevail. Users must check results before official use.

5. Account

Some functions need a personal account. Registration data must be correct. An account may generally be used only by the person it was created for. Do not share credentials. Protect the account against unauthorised access. Report suspected misuse promptly to team@stockarena.eu. Different account types and permission levels may exist.

6. Minimum age

StockArena is not directed at persons under 16. A regular account may generally be created only from age 16. Accounts may be blocked or deleted if there are concrete indications that this is not met.

7. Closed beta and test programmes

Participant numbers or platforms may be limited. There is no entitlement to admission, a platform, lasting participation, a feature set, test tasks or a release date. Access may depend on slots, platform, technical need, phase, activity or security and may be ended. Ending beta does not automatically delete the account.

Beta software is in development. It may contain errors, be incomplete, change or fail. Do not keep important data only in StockArena during a beta.

8. Permitted use

Use StockArena only within the intended functions and applicable law. In particular do not post unlawful content, insult or harass others, post deceptive content with intent to harm, use someone else’s account, impersonate others, bypass protections, exploit vulnerabilities, run automated access that significantly impairs the service, overload it, introduce malware or access data without permission.

Do not run technical investigations or security tests against production systems without prior consent. Report security issues to team@stockarena.eu.

9. User content

You remain responsible for content you post (texts, comments, team names, images, events, polls, notes, feedback, signatures and other uploads). Upload only content you may use. Do not infringe copyright, personality, trade-mark, data-protection or other third-party rights.

Necessary licence

By uploading or creating content you grant StockArena only the non-exclusive rights technically needed to provide the requested function: store, process, display, share with people or groups you choose, and back up. StockArena does not acquire ownership. The licence generally ends when the content or account is deleted, unless further storage is still needed in existing backups or for another lawful reason.

10. Images and other people’s data

If you post images or information about others, you are responsible that this is allowed (photos, names, signatures and other personal content). Do not use StockArena to publish confidential or specially protected information about others without a proper reason.

11. Groups

Groups are for exchange within the intended circle. Do not publish closed-group content outside the group without consent if it is clearly group-internal. Admins or authorised persons may manage posts, members, events, polls or moderation as the functions allow.

12. Reports and moderation

Report breaches to team@stockarena.eu or, where available, inside StockArena. StockArena may review or remove content, inform users, warn, restrict functions or write rights, or block accounts temporarily or permanently, taking into account severity, impact, repetition, security and legal duties. Serious security issues or obvious abuse may lead to an immediate block. A moderation measure does not automatically delete the whole account and all stored data.

13. Public and shared links

Some functions share content via a link or token. Anyone with the link may access the released content. Share such links only with the intended people and treat them like an access link. StockArena may disable links for technical, security or other factual reasons.

14. Signatures and scoresheets

A digital signature on a scoresheet is for sporting documentation in StockArena. It is not automatically a qualified or other special electronic signature in the legal sense. No particular legal evidential effect outside the intended sporting use is guaranteed.

15. Storage and export

StockArena is not a lasting archive or backup. Volume, storage, age limits or automatic clean-up may apply. Current limits may be described in the app or privacy notice. If export exists, export and keep important data yourself. There is no entitlement to unlimited or lasting storage. Accidental or technical deletion cannot be fully excluded.

16. Offline use and sync

Some functions may work temporarily without internet. Later sync may cause delays, conflicts or differences between local and server state. A server-side block may take effect on an offline device only at the next connection.

17. Feedback

Feedback and suggestions are welcome and may be used to improve StockArena. A suggestion alone creates no claim to implementation, payment, a share in StockArena or a particular credit. Independent protected works and mandatory legal rights remain.

18. Rights in StockArena

Rights in StockArena itself (software, source, database structure, design, own graphics, texts and other operator content) remain with the respective rightsholder. Open-source components and third-party content stay under their licences. Use does not grant a right to copy, distribute or otherwise exploit the software beyond normal intended use, unless the law or an express grant says otherwise.

19. Availability and development

No particular service level or minimum availability is promised. Maintenance, development, fixes, security, third-party outages or technical problems may limit availability. Functions may be added, changed or removed. There is no entitlement to keep any single function forever.

20. Discontinuing StockArena

Because the project is private and free, operation or essential parts may be discontinued. Where this is plannable and reasonable, users will be informed in time and, where technically possible, given a chance to export relevant data. Security, legal, technical emergencies or circumstances beyond the operator’s control may require a shorter notice.

21. Liability

StockArena is developed and operated with due care. Given its private, unpaid nature, no warranty is given for uninterrupted availability, complete freedom from errors, lasting storage, correctness of all calculations or fitness for a particular purpose. Check sporting results before official use.

Statutory liability

Liability for intent or gross negligence follows the law. Liability for personal injury and any liability that may not legally be excluded remains. To the extent permitted, there is no liability for damage caused solely by slight negligence that does not affect an essential duty of the use agreement. Indirect damage, data loss or downtime is only covered insofar as the law mandatorily requires. These rules are not meant to cut mandatory statutory claims.

22. External services

Hosting, authentication, maps, weather, email, app stores or technical protection may rely on other providers. Their availability cannot be guaranteed. Their own terms may apply. Processing of personal data by those services is described in the privacy notice.

23. Blocking by StockArena

An account or functions may be restricted or blocked for a factual reason, including serious or repeated breaches, unlawful content, abuse, attacks, risk to others, relevant false statements, security issues or legal duties. Where possible, the user should be told the reason for a material restriction. Lesser breaches may first lead to a warning. Serious breaches may require an immediate block.

24. Ending use yourself

You may stop using StockArena at any time. Where provided, delete the account in the app or write to team@stockarena.eu. Ending beta alone does not delete the account. Deletion of personal data is described in the privacy notice.

25. Changes to these terms

Editorial clarifications may be published without material worsening of users’ legal position. Material changes will be announced in the app or by system email. Where a new consent is required, it will be asked for expressly. Without that consent, functions that need the new terms may become unavailable. 26. Applicable law

Austrian law applies where legally permitted. Mandatory protective rules that apply regardless of this choice remain. These terms do not agree an exclusive venue to the detriment of users.

27. Invalid provisions

If a provision is wholly or partly invalid, the rest remains insofar as legally possible. Statutory rules apply in place of the invalid provision.
